New Mexico Bicycle Laws

Everyone should familiarize themselves with New Mexico’s state bicycle laws. Why? Not everyone may cycle, but most of us drive regularly and therefore we need to be aware of how to share the road with bicyclists to keep everyone safe. Cyclists, of course, should ensure they are following the law for safety reasons as well.

Relevant state laws include:

  • Under New Mexico Statutes § 32A-24-3, all minors (individuals under the age of 18) must wear a helmet while operating or riding on a bicycle (or similar contraption, like a scooter).
  • Under NM Stat § 66-3-706, “No person operating a bicycle shall carry any package, bundle or article which prevents the driver from keeping at least one hand upon the handlebar.” That’s right, the old “look ma, no hands!” trick does not fly.
  • And perhaps most importantly of all, from NM Stat § 66-3-702, any person riding a bicycle on a roadway “shall be granted all of the rights and shall be subject to all of the duties applicable to the driver of a vehicle.”

That’s right, motorists—cyclists have just as much freedom to be on the road as you! Cyclists, this is a right you must treat responsibly. If both cyclists and motorists practiced vigilance (and stayed off their phones) while operating their rides, the roads would be a far safer place.

What to Do After a Bicycle Accident

First, you should seek medical attention—especially if you’ve been seriously injured. Cyclists are very likely to suffer moderate to serious injuries due to the lack of protection a bicycle affords.

Common bicycle accident injuries include:

  • Scrapes, cuts, bruises
  • Traumatic brain injuries, such as concussions
  • Broken bones
  • Face and head injuries
  • Soft tissue injuries
  • Internal bleeding
  • Back and spinal cord injuries
